1. Introduction

Welcome to Amref Events. These Terms and Conditions (“Terms”) govern your use of our events application (“App”). By downloading, accessing, or using our App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. User Accounts

2.1 Registration: To access certain features of the App, you must register for an account. You agree to provide accurate and complete information during the registration process and to keep your account information up to date.

2.2 Account Security: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Use of the App/Website

3.1 Prohibited Activities: You agree not to:

•           Use the App for any unlawful purpose or in violation of any local, state, national, or international law.

•           Use the App to transmit any harmful, offensive, or otherwise objectionable content.

•           Interfere with or disrupt the operation of the App or the servers or networks used to make the App available.

•           Attempt to gain unauthorized access to the App, other user accounts, or computer systems or networks connected to the App.

4. Content

4.1 User Content: You retain ownership of any content you post, upload, or otherwise make available through the App (“User Content”). By making User Content available through the App, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, and perform your User Content in connection with operating and providing the App.

4.2 Prohibited Content: You agree not to post, upload, or otherwise make available any User Content that:

•           Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

•           Infringes the intellectual property rights or privacy rights of any third party.

•           Contains viruses or any other harmful code.

5. Event Listings

5.1 Accuracy: While we strive to provide accurate information about events, we do not guarantee the accuracy, completeness, or timeliness of any event listings.

5.2 Third-Party Events: Our App may include listings for events hosted by third parties. We are not responsible for the conduct of these third parties or the content of their events.

6. Payments and Refunds

6.1 Payments: Some events or features within the App may require payment. All payments are processed securely through third-party payment processors.

6.2 Refunds: Refunds are subject to the refund policies of the event organizers. We are not responsible for issuing refunds for events hosted by third parties.

7. Intellectual Property

7.1 Our Content: All content and materials available on the App, including but not limited to text, graphics, logos, icons, images, and software, are the property of Amref Health Africa or its licensors and are protected by intellectual property laws.

7.2 Trademarks: Amref Events and all related logos and designs are trademarks of Amref Health Africa. You may not use our trademarks without our prior written permission.

8. Disclaimers and Limitation of Liability

8.1 Disclaimers: The App/website is provided on an “as is” and “as available” basis. We disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 Limitation of Liability: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the App; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

9. Indemnification

You agree to indemnify, defend, and hold harmless Amref Health Africa, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to lawyer’s fees) arising from: (a) your use of and access to the App; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; or (d) any claim that your User Content caused damage to a third party.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or through the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
